These terms and conditions set out the basis on which you can use our website and place orders for items from Affordable Mobility. By ordering goods from Affordable Mobility you are deemed to have understood and accepted these terms.

Telephone calls to and from Affordable Mobility may be recorded or monitored as part of our efforts to further improve service to our customers. Unless stated otherwise, all calls to Affordable Mobility are at the standard rate from a BT landline, charges from mobile providers and other networks may vary.

We may contact you for marketing purposes by email, mail or telephone with relevant offers and for market research purposes.

Mail & Telephone Order payments service (WorldAccess) - By Credit & Debit Cards

You may call us on 01200 444254 to pay by phone. We accept all major credit and debit cards. Please print off our order form from the home page of this store and fill in your details as required. You can rest asured that all your details will be kept in the strictest confidence and all documentation once processed is distroyed immediately. This applies should you purchase items from our catalogues or any other type of literature we may provide from time to time. Your security will always be our number one priority.

The Mail & Telephone Order payments service is a secure payment service offered by Worldpay for the specific use of Mail Order & Telephone Order sales.

The card must be registered to the address where your goods are to delivered.


On-line

We accept all major credit and debit cards via our website. You have an option of payment by these methods using leading online payment companies, specialising in providing online payment services. WorldPay is the quick and easy way to make secure on-line payments by all the major credit and debit cards via our website. Alternatively you may choose PayPal and either pay using your PayPal account or if you do not have one then you can still pay via PayPal without an account using the correct links on their secure site.

We are unable to accept cards that are due to expire within the next 5 days. Card details are checked and verified by a third party (our bank) and goods are despatched once authorisation has been obtained.


Orders

A contract is formed between Affordable Mobility and you when we despatch the goods you have ordered. Until the goods are despatched the order may be cancelled. Exceptions apply to orders for personalised items and goods made to your order, which cannot be cancelled once you have received email confirmation that your order has been accepted. For security reasons, until you have placed an order for goods, received your first email and a payment has been received for those goods, you will be unable to ask for delivery to an alternative address. For payment and security reasons we may restrict the volumes of certain items to be sold in any one transaction. This is to protect all card users from fraud.

Offers and Specials Codes

Specials and other offer codes remain the property of Affordable Mobility, are non-transferable and may not be reproduced in any form or used in conjunction with any other offer.

Cancellation

Under the Consumer Protection (Distance Selling) Regulations 2000 you have the right to cancel your order within a period of 7 working days. The period of 7 working days begins on the day after the day you receive your goods. Please be aware that your right to cancel does not apply to certain goods that we sell, for example, items made to special order.

You must inform us of your wish to cancel in writing either by letter or email within a period of 7 working days. The period of 7 working days begins on the day after the day you receive your goods. You must take reasonable care of the goods and not use them.

You should return goods to us in their original packaging, wherever possible, as soon as possible after informing us of your wish to cancel. If you return goods to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage.

Additional terms and conditions apply to cancelling orders for certain goods, such as made to order items, large items of furniture, perishable goods etc. Please refer to the terms relating to the supply of these goods.


Prices

The prices quoted are those ruling at the time of production. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of value added tax. The correct price will be shown when you place your order. All prices shown are cash prices in sterling. Prices of goods displayed in and ordered through the store may differ from prices on-line. We reserve the right to cancel an order if a mistake has been made on-line with the price and you will be informed as soon as it is possible to do so.


Availability

All orders for products are subject to availability. In the event of seasonal supply difficulties we reserve the right to substitute of equal quality and value. Labels may vary from those shown.


Colour Reproduction

The limitations of colour reproduction and the individual colour settings of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.

Customer Ratings And Reviews

These Terms of Use govern your conduct associated with the Customer Ratings and Review service offered by Affordable Mobility. To the extent of any conflict between our Privacy Policy and these Terms of Use, these Terms of Use will take precedence in respect of the Customer Ratings And Reviews Service.

By submitting any content to Affordable Mobility, you represent and warrant that:

  • You are the sole author and have not copied the content from any third party;
  • All content that you post is accurate;
  • Use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.


You further agree and warrant that you shall not submit any content:

  • That is known by you to be false, inaccurate or misleading;
  • That infringes any third party’s copyright, trademark, or privacy;
  • That is, or may reasonably be considered to be, defamatory, racially or religiously biased or offensive, contains obscene language, or is threatening or harassing to any individual, partnership or corporation;

For any content that you submit, you grant Affordable Mobility a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or distribute such content and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.

All content that you submit may be used at our sole discretion. We reserve the right to change, condense or delete any content on our websites that we deem, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. We do not guarantee that you will have any recourse through Affordable Mobility to edit or delete any content you have submitted.

Ratings and written comments are generally posted within hours. However, we reserve the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not Affordable Mobility, are responsible for the contents of your submission.

None of the content that you submit shall be subject to any obligation of confidence on the part of Affordable Mobility, its agents, subsidiaries, affiliates, partners or third party service providers and their respective directors, officers and employees.

By submitting your email address in connection with your rating and review, you agree that Affordable Mobility and its third party service providers may use your email address to contact you about the status of your review and other administrative purposes.

Availability and Deliverability

Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within 30 days of the date of the Dispatch Confirmation, unless there are exceptional circumstances. We will contact you if your order will not be fulfilled within this time. In the unlikely event we are unable to supply the product ordered, we will advise you as soon as is possible.


Corrections

Descriptions of goods and services included on the site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should be aware that the colours and appearance of images may vary very slightly from the way they appear on the screen. Also sizes can vary slightly between production batches. For this reason, we bly recommend that if you need to know the precise dimensions of a product, please contact us.

Product dimensions, weights, colours & specifications

It is important to note that the product dimensions do not include any protruding features such as, controls and handles etc. Product dimensions represent the casing of the units only.

Whilst we try to be as accurate as possible, all sizes, weights and measurements quoted on this website are approximate.

Images of the products shown on this website are for illustrative purposes only. We have made every effort to display all product colours accurately. However we cannot guarantee that the image displayed on your monitor will accurately reflect the true colour of the product delivered to you. Items Made to Order Terms & Conditions Only

Occasionally customers require items made to special order. These can include items such as Fireside Chairs, Rise & Recline Chairs and other Bespoke items. The following are the terms and conditions for those occassions.


Measurements - Items Made to Order

Please check your measurements styles to ensure that the correct sizes and colours are ordered. All products are to fit the measurements you have provided and are made to order and orders cannot therefore be cancelled or altered once the order has been placed.

WE STRONGLY RECOMMEND THAT YOU VISIT OUT STORE TO VIEW FABRIC SAMPLES BEFORE GOODS ARE ORDERED TO ENSURE THE COLOUR AND TEXTURE ARE TO YOUR LIKING.

Computer monitors vary greatly in colour and shade representation and are not an exact representation of the product.


Cancellations - Items Made to Order

Once a special bespoke item made to order has been placed and work has commenced in any way then cancellation is not possible on the order. This is due to the products bespoke nature.


Availability - Items Made to Order

All products are subject to availability. Availability is usually advised when placing an order but if this is not possible we will advise of any delay as soon as possible.


Contract - Items Made to Order

There will be no contract of any kind between you and us until payment for your goods is authorised by your bank or credit card issuer or until clearance of a cheque. At any point up until then, we may decline to supply the goods to you without giving any reason. At the moment that payment for the goods is authorised, (and not before), a contract will be made between you and us. Authority for payment must be given at the time of the order. Payment for your order will be taken once stock availability has been confirmed. If for any reason the goods can not be supplied then payment will be refunded in full. Refunds can take up to 30 days as per the Distant Selling Directive.


Payment - Items Made to Order

Payment will usually be taken in full at the time of ordering for all bespoke made to special order goods. You can pay for your goods with any of the following Maestro, MasterCard, American Express or Visa debit or credit cards. You may also pay via PayPal. Your payment card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. It may be necessary to re-confirm your security number for data protection reasons. Payment will be taken for out of stock goods to secure stock, only if you are happy to proceed with the order and agree to wait for the order.


Liability

The following provisions set out the entire financial liability of Affordable Mobility (including any liability for the acts or omissions of its employees, agents and sub-contractors) to you in respect of:

  • any breach of these conditions;
  • any use made or resale by you of any of the goods, or of any product incorporating any of the goods; and
  • any representation, statement or tortious act or omission including negligence arising under or in connection with the Contract.
All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are to the fullest extent permitted by law excluded from the Contract. Nothing in these conditions excludes or limits the liability of Affordable Mobility:
  • for death or personal injury caused by Affordable Mobility negligence; or
  • under section 2(3), Consumer Protection Act 1987; or
  • for any matter which it would be illegal for Affordable Mobility to exclude or attempt to exclude its liability; or
  • for fraud or fraudulent misrepresentation.
Subject to the above clauses:
  • Affordable Mobility total liability in contract, tort (including negligence or breach of legal duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the Contract shall be limited to the Contract price; and
  • we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at a the time you make the relevant order. Our liability shall not in any event include loss of profit, loss of revenue, loss of business, wasted expenditure, depletion of goodwill, and loss of privacy or any other claims which arise out of or in connection with the Contract.


Free Delivery - Mobility Scooters

Free delivery on mobility scooters is restricted to a 100 mile radius of our store in Clitheroe, Lancashire, BB7 2DL. Please do enquire if you are covered for free delivery before you purchase your scooter from us.

This does not affect free delivery on any other qualifying product range.

General

These Product Terms shall be governed by and construed in accordance with the laws of England and Wales and any disputes will be decided only by the English courts. If any of these Product Terms is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Product Terms which will continue to be valid and enforceable to the fullest extent permitted by law.
